| Quote: | Oreo Defense Used in Conn. Speeding Case
SALISBURY, Conn. (AP) -- Police say a man's excuse for speeding through a small Connecticut town takes the cake - or, at least, the cookie.
A state trooper who stopped the 1993 BMW last fall says its driver, 28-year-old Justin Vonkummer of Millerton, N.Y., blamed his driving problems on an errant Oreo.
Vonkummer told the trooper that an Oreo had just slipped from his fingers as he dunked it in a cup of milk, and that he was trying to fish it out when he lost control of his car.
Prosecutors learned in court this week that Vonkummer had been charged with speeding and driving under a suspended license - not driving under the influence, as a clerk had mistakenly noted in the court records.
Vonkummer's attorney declined to comment. The case is pending.

"This case is pending."
Being a lover of Oreo cookies is a huge mitigating factor, but I don't think it will get him totally off the hook. |

Yeah - but his defense for reckless driving is that he fumbled while dunking his oreo in milk????
He better PRAY his judge is another oreo freak. |

lol.
It's probably the truth and what he told the officer who stopped him and what the officer wrote in his report or on the ticket. But you're right, it won't impress any judge as a legitimate excuse. It demonstrates the difference between a reason and an excuse, a difference lost on many defendants, especially criminal types. Fumbling over a dropped cookie is as good a reason as any to lose control of your car, but it is no excuse. |

| His lawyer probably does know, but what else are they going to try? |

| I'm guessing he told the officer about fumbling for a cookie and the officer wrote it on the ticket or report and it was picked up by the weird news media from there, well before he'd hired a lawyer or appeared in court. His lawyer definitely wishes the Oreo cookie story had never come to light. |
